CONDITIONAL WAIVER AND RELEASE ON PROGRESS PAYMENT
NOTICE: THIS DOCUMENT WAIVES THE CLAIMANT'S LIEN, STOP PAYMENT NOTICE, AND PAYMENT BOND RIGHTS EFFECTIVE ON RECEIPT OF PAYMENT. A PERSON SHOULD NOT RELY ON THIS DOCUMENT UNLESS SATISFIED THAT THE CLAIMANT HAS RECEIVED PAYMENT.
Upon receipt by the undersigned claimant (Lone Star Structural Concrete, Inc.) of a check from Apex Meridian Construction Group, LLC in the sum of $148,500 payable to Lone Star Structural Concrete, Inc., and when the check has been properly endorsed and has been paid by the bank upon which it is drawn, this document shall become effective to release any mechanic's lien, stop payment notice, or bond right the claimant has on the job of Congress Avenue Mixed-Use Tower — Phase II located at 740 Congress Ave, Austin, TX 78701 to the following extent: This document covers a progress payment for all labor, services, equipment, or materials furnished to the jobsite through 2026-10-31 only and does not cover any retention withheld, pending modifications and changes, or items furnished after 2026-10-31.
Before any recipient of this document relies on it, said party should verify evidence of payment to the claimant.
